These Terms & Conditions (“Terms”) apply to your use of tensorten.com (the “Website”) and to the SMS text messages and emails you receive from TensorTen (“TensorTen”, “we”, “us” or “our”). By using the Website or agreeing to receive our messages, you agree to these Terms. If you do not agree, please do not use the Website.
Our Privacy Policy explains how we handle personal information and forms part of these Terms.
2. About TensorTen
TensorTen is a software consultancy based in Brampton, Ontario, Canada. We advise businesses on technology, and we design, build and run web platforms, online stores and AI-assisted tools. You can reach us at transofinc@gmail.com.
3. Using this website
You may use the Website for lawful purposes only. You agree not to:
- try to gain unauthorized access to the Website, our servers or any connected system;
- interfere with the Website’s operation, or introduce viruses or other harmful code;
- copy, scrape or republish the Website’s content for commercial purposes without our written permission;
- impersonate any person or business, or misrepresent your connection to them; or
- use our contact details to send spam or unsolicited messages.
4. Our services
The Website describes our services in general terms and is not an offer to provide them. Any project we carry out for you is governed by a separate written agreement, such as a proposal, statement of work or contract. If that agreement conflicts with these Terms, the agreement applies.
5. SMS text messaging
These terms apply to text messages (SMS) we send to you.
By providing your mobile phone number, you agree to receive text messages from TensorTen at the number provided, sent using an automated system. Consent is not a condition of purchase. Message frequency varies. Message and data rates may apply. Reply STOP to cancel or HELP for help. For additional assistance, contact transofinc@gmail.com. Carriers are not liable for any delayed or undelivered messages. See our Privacy Policy for how we handle your personal information.
- What we send. TensorTen sends text messages to people who have opted in. These include service messages — project and appointment updates, verification codes, account notifications and replies to your enquiries — and, only if you have separately agreed to them, occasional promotional messages. Messages are identified as TensorTen, or as the product they relate to (such as TranSof).
- Opting in. By giving us your mobile number and agreeing to receive text messages, you consent to receive SMS messages from TensorTen at that number. Agreeing to receive text messages is not a condition of buying any product or service.
- Frequency. Message frequency varies.
- Cost. Message and data rates may apply. We do not charge for text messages; any charges come from your mobile carrier under your plan.
- Opting out. Reply STOP at any time to stop receiving messages (where replies are supported), follow the opt-out instructions in a message, or contact us at transofinc@gmail.com. You may receive one final message confirming your opt-out.
- Help. Reply HELP for help, or contact us at transofinc@gmail.com.
- Delivery. Mobile carriers are not liable for delayed or undelivered messages. We cannot guarantee that every message will be delivered or arrive on time.
- Your number. You confirm that you are the account holder of the mobile number you give us, or have the account holder’s permission to use it. Please tell us if you change or give up that number.
- Privacy. We do not share your mobile number or SMS consent with third parties or affiliates for their marketing or promotional purposes. See our Privacy Policy for details.
6. Intellectual property
The Website and its content — including text, design, graphics, logos and code — belong to TensorTen or its licensors and are protected by copyright and trademark laws. You may view and print pages for your own personal, non-commercial use. TranSof and other product names and logos shown on the Website are the trademarks of their respective owners.
7. Third-party websites
The Website may link to other websites. We provide these links for convenience only; we do not control those websites and are not responsible for their content, policies or practices.
8. Disclaimer
The Website is provided “as is” and “as available”. We work to keep its information accurate and up to date, but we make no warranties that it is complete, current or error-free, or that the Website will always be available, to the extent permitted by law.
9. Limitation of liability
To the fullest extent permitted by law, TensorTen is not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill, arising from your use of the Website or our messages. Nothing in these Terms limits any liability that cannot be limited under applicable law.
10. Indemnity
You agree to indemnify TensorTen against any claims, losses or costs, including reasonable legal fees, arising from your misuse of the Website or your breach of these Terms.
11. Governing law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. Any dispute will be resolved in the courts of Ontario.
12. Changes to these terms
We may update these Terms from time to time. When we do, we will post the new version on this page and change the “last updated” date above. By continuing to use the Website after a change, you accept the updated Terms.
